Seattle Line Communications can provide a web page for
each of its customers so they can monitor their bandwidth usage. This service
is provided by MRTG software that displays the average packet rate for any IP
port specified on 5-minute intervals. This is plotted in daily, weekly,
monthly and yearly graphs. The customer may have to provide a gateway router,
switch or firewall that is SNMP MIB II compatible for this application to
work. To access these report graphs, the customer will be given a user name
and password assigned by Seattle Line Communications.

1. INTRODUCTION Seattle Line Communications' (SLC) Acceptable Use Policy (AUP) is intended to help enhance the use of the Internet by preventing unacceptable use. All users of SLC’s Internet products (Products), those who access some of our Products but do not have accounts ("Visitors"), as well as those who pay a monthly service fee to subscribe to the Products (Customers) must comply with this AUP. We support the free flow of information and ideas over the Internet and do not actively monitor use of the Products except for metering and graphing of data transfer rates under normal circumstances. Similarly, we do not exercise editorial control over the content of any Web site, electronic mail transmission, news group, or other material created or accessible over or through the Products, except for certain proprietary websites. However, in accordance with our Service Order Agreement, we may remove any materials that, in our sole discretion, may be illegal, may subject us to liability, or which may violate this AUP. SLC may cooperate with legal authorities and/or third parties in the investigation of any suspected or alleged crime or civil wrong. Your violation of this AUP may result in the suspension or termination of either your access to the Products and/or your SLC account or other actions as detailed in Section 3. This AUP should be read in conjunction with our Service Order Agreement and other policies. 2. VIOLATIONS OF SLC’s ACCEPTABLE USE POLICY The following constitute violations of this AUP: a. Illegal use. Using the Products to transmit any material (by email, uploading, posting, or otherwise) that, intentionally or unintentionally, violates any applicable local, state, national or international law, or any rules or regulations promulgated thereunder. b. Harm to minors. Using the Products to harm, or attempt to harm, minors in any way. c. Threats. Using the Products to transmit any material (by email, uploading, posting, or otherwise) that threatens or encourages bodily harm or destruction of property. d. Harassment. Using the Products to transmit any material (by email, uploading, posting, or otherwise) that harasses another. e. Fraudulent activity. Using the Products to make fraudulent offers to sell or buy products, items, or products or to advance any type of financial scam such as "pyramid schemes," "Ponzi schemes," and "chain letters." f. Forgery or impersonation. Adding, removing or modifying identifying network header information in an effort to deceive or mislead is prohibited. Attempting to impersonate any person by using forged headers or other identifying information is prohibited. The use of anonymous re-mailers or nicknames does not constitute impersonation. Using deliberately misleading headers ("munging" headers) in news postings in order to avoid spam email address collectors is allowed. g. Unsolicited commercial email/Unsolicited bulk email. Using the Products to transmit any unsolicited commercial email or unsolicited bulk email. Activities that have the effect of facilitating unsolicited commercial email or unsolicited bulk email whether or not that email is commercial in nature are prohibited. h. Unauthorized access. Using the Products to access, or to attempt to access, the accounts of others, or to penetrate, or attempt to penetrate, security measures of SLC’s or another entity's computer software or hardware, electronic communications system, or telecommunications system, whether or not the intrusion results in the corruption or loss of data. i. Copyright or trademark infringement. Using the Products to transmit any material (by email, uploading, posting, or otherwise) that infringes any copyright, trademark, patent, trade secret, or other proprietary rights of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmittal of copyrighted software. SLC is registered under the Digital Millennium Copyright Act of 1998. j. Collection of personal data. Using the Products to collect, or attempt to collect, personal information about third parties without their knowledge or consent. k. Reselling SLC’s Products. Reselling the Products without SLC’s authorization. l. Network disruptions and unfriendly activity. Using the Products for any activity that adversely affects the ability of other people or systems to use SLC’s Products or the Internet. This includes "denial of service" (DoS) attacks against another network host or individual user. Interference with or disruption of other network users, network products or network equipment is prohibited. It is the Member's responsibility to ensure that their network is configured in a secure manner. A Member may not, through action or inaction, allow others to use their network for illegal or inappropriate actions. A Member may not permit their network, through action or inaction, to be configured in such a way that gives a third party the capability to use their network in an illegal or inappropriate manner. m. News. SLC Customers should use their best judgment when posting to any newsgroup. Many groups have charters, published guidelines, FAQs, or "community standards" describing what is and is not considered appropriate. Usenet can be a valuable resource if used properly. The continued posting of off-topic articles is prohibited. Commercial advertisements are off-topic in most newsgroups, especially regional groups not specifically named for such. The presence of such articles in a group is not indicative of the group's "intended" use. Please familiarize yourself with basic Usenet netiquette before posting to a newsgroup. SLC considers "multi-posting" to 10 or more groups within a two-week sliding window to be excessive. SLC servers currently limit the number of allowable "cross-posts" to 9. SLC Customers may not cancel messages other than their own messages. A Member may cancel posts forged in that Member's name. We may cancel any postings that violate this AUP. n. Long Connections and Multiple Logins for Non-Commercial or Residential or Personal Use Customers. Using a personal or residential account for high volume or commercial use is prohibited. The Residential Products are intended for periodic, active use of email, newsgroups, file transfers, Internet chat, games, and browsing the World Wide Web. Customers may stay connected so long as they are actively using that connection for the above purposes. Customers may not use the Products on a standby or inactive basis in order to maintain a connection. Pinging is expressly prohibited. Accordingly, SLC maintains the right to terminate any member's connection following any extended period of inactivity as determined by SLC. o. Exceeding Web Site Size and Traffic Limitations: Some SLC Customers may receive webspace for use with their Residential SLC Internet access account. Each member's webspace is allocated a certain amount of traffic per month (traffic is either metered or calculated on a formula multiplying the number of hits that your site receives by the size of your files). If a site exceeds its maximum monthly allotment of traffic, the site will become unavailable until the beginning of the next calendar month. A site that exceeds the SLC’s Member's maximum allotment in size will also become unavailable. Unavailability includes but may not be limited to the inability to access the site publicly or to publish to or modify the site's contents via certain Web creation tools. p. Greatly exceeding the contracted bandwidth amounts or allowing certain server activity causing disruptions and/or excessive loading of the radio network: SLC commercial customers may not install certain applications on their servers that create undo packet loading on SLC’s Radio Network without first obtaining permission from SLC. Such activities may be of the form of streaming media or game servers that by their very nature tend to create excessive packet traffic thereby blocking access to the network by other customers. Residential customers are not allowed the use of commercial servers or private servers that have excessive hits causing possible congestion, disruption or degradation of the radio network. SLC reserves the right at it’s discretion to terminate service temporarily until the situation is remedied or permanently without violating the customer’s service agreement if such activity is causing harm to other customers or the integrity, speed or performance of the radio network. 3. REPORTING VIOLATIONS OF SEATTLE LINE COMMUNICATIONS’ AUP SLC requests that anyone who believes that there is a violation of this AUP direct the information to Director of Operations, at: WebInfo@SeattleLine.com. If available, please provide the following information: · The IP address used to commit the alleged violation · The date and time of the alleged violation, including the time zone or offset from GMT (also known at UTC or Zulu) · Evidence of the alleged violation Email with full header information provides all of the above, as do syslog files. Other situations will require different methods of providing the above information. SLC may take any one or more of the following actions in response to complaints: · issue warnings: written or verbal · suspend the Member's newsgroup posting privileges · suspend the Member's account · terminate the Member's account · bill the Member for administrative costs and/or reactivation charges · bring legal action to enjoin violations and/or to collect damages, if any, caused by violations. 4. REVISIONS TO THIS ACCEPTABLE USE POLICY SLC reserves the right to revise, amend, or modify this AUP, our Service Order Agreement and our other policies and agreements at any time and in any manner. Notice of any revision, amendment, or modification will be posted on our web site at www.SeattleLine.com in accordance with the Service Order Agreement. This WIRELESS INTERNET ACCESS AGREEMENT (Agreement) is entered into this ______ day of ____________, _____, between Seattle Line Communications, Inc. (SLC), and _________________________________________________(Customer). 1. SLC shall provide the Customer ___ connection(s) to the Internet from SLC's closest Point of Presence (POP) at shared ______ Megabits per second burstable rate and nominally symmetric bandwidth (the Connection). The Customer shall pay to SLC the sum of $________ per month every month in advance during the term hereof plus a one time installation fee of $___________ both of which shall be due upon the Customer’s execution hereof. The Customer shall be entitled to use this Connection for the transfer of data to and from the Internet of no more than ____ Gigabytes of IP data per month. Any additional information transfer in any given month shall be charged an additional rate of $20 for every Gigabyte or fraction thereof exceeding this amount. Customer may select at any time additional Gigabyte packages, by placing an order to the Sales department. Such an order will constitute an addendum to this Agreement. 2. The Customer shall receive from SLC the requirements necessary to provide the Customer with the Connection which shall include, but not be limited to router configuration information, local loop information and the demarcation point (Requirements) and the date on which the Requirements must be fulfilled. 3. Additional charges or changes in service ordered by the Customer at a later time may require the execution of another Agreement with attached Service Order. 4. This Agreement shall commence on the date the Connection is activated (the "Activation Date") which shall be on or before _________________________, 2001 for a term of ____ year(s) and ________ days at which time this Agreement shall automatically renew for successive one year terms unless terminated by either party at least 30 days prior to the then current date for termination. SLC reserves the right to change it's rates for 1 year renewal term by notifying the Customer at least 30 days in advance of the effective date of such a rate change. The Customer acknowledges that circumstances beyond the control of SLC may cause a delay in activating the Connection in which case the term of this Agreement shall commence on the date the Connection is activated; provided, however, in the event the delay in activating the Connection is the result of the Customer's failure to comply with or provide any of the Requirements of this Agreement, shall commence on the activation date previously agreed to and stated herein. 5. The Customer understands that setup fees are non-refundable if the wireless connection is operable, and that setup fees are not refundable later than 14 days after installation. Setup fees are only refundable if the connection is not working within 14 days after installation. 6. SLC reserves the right to deny service to any Customer who damages or degrades the over the air network for any reason, intentional or otherwise, as the bandwidth for this type of connection may be shared over the air. As degradation of the over-the-air network can occur because of excessive use of bandwidth or the creation of packet storms, viruses or any other such cause, SLC shall have the right to take any preventive measures it deems necessary to protect the over-the-air network from such degradations including but not necessarily, temporary interruption of service. If possible, the individual or business will receive a warning and have 24-hours from such warning to rectify the situation. At that time the Customer may be permanently throttled to a lower speed connection, disconnected or may be required to upgrade their connection to a dedicated (non-shared) wireless connection. 7. SLC, solely, shall hold all password and authentication information on the SLC connected router at the Customer's location until termination of this Agreement. Upon termination of this Agreement SLC shall provide the Customer with passwords to all Customer-owned equipment that SLC holds. 8. SLC is not responsible or liable for any of the following: (a) Any obstruction(s) that might be erected or grow between the Customer's antenna and SLC's POP causing degradation or loss of service; (b) Debris or ice on antenna; (c) Re-aiming the antenna later than 14 days after installation; (d) Installing hardware and/or software in a different computer or router after initial installation; (e) Re-configuration of network settings due to, but not limited to: tampering, re-installation of operating system, accidental removal, or moving the hardware to another computer or location. 9. The Customer understands that wireless Internet connectivity requires direct radio line of sight, and that any obstruction between SLC and the Customer’s antenna may block or adversely affect the signal and bandwidth capabilities or speed of the connection. The Customer understands that tree leaves may absorb the microwave signal and may degrade or disrupt the Customer's Internet connectivity performance. The Customer also understands that wireless equipment installed during a time of year when there are little or no leaves in the trees may risk loosing connectivity when the leaves come back in the Spring. The Customer may require extra hardware and setup at that time. SLC shall not be held liable for this situation and/or any additional charges for such remedy work nor will the Customer be entitled to any type of refund. However if service is interrupted due to exclusively equipment or hardware failure of SLC’s network for a continuous 2-week period, the Customer has the option to declare this Agreement in default and all subsequent obligations under the terms of this Agreement shall become null and void. 10. This Agreement does not include any other incidental or additional charges such as additional network equipment, wiring or additional installation charges ordered by the Customer, additional IP addresses or other charges to be determined or agreed to by the Customer outside the scope of this written Agreement. Additional telecommunications work ordered by the Customer to be performed at or after installation of this service shall be executed by a separate agreement and invoice. 11. The Customer will be invoiced monthly in advance for all amounts due and owing to SLC. All payments are due and payable within 15 days after the date of such invoice. The Customer may be disconnected if payment is not received within 20 days of the date of such an invoice. 12. The wireless radio, antenna, support mast, power supply, hub/switch, cable and any other equipment or material supplied by SLC to accomplish the installation of service are the property of SLC, and shall be returned to SLC, in original condition, within 5 days of service termination. The Customer shall allow SLC employees to remove the hardware and material from the Customer premises and the Customer’s building upon notice of such action by SLC. 13. If The Customer terminates this Agreement anytime after implementation, but before expiration, the Customer shall pay a lump sum equal to the charges of the remainder of the then current term of the Agreement in no case greater than 1 year. If SLC terminates the Customer for violation of the Acceptable Use Policy described herein and elsewhere, the Customer shall have a 72-hour period during which the Customer must fix the problem(s) associated with the violation or pay, immediately, a lump sum equal to the charges for the remainder of the then current term of the Agreement, in no case greater than 1 year. 14. SLC
offers the Customer access to the Internet. The Customer
hereby acknowledges that the Internet is not owned, operated, managed by, or
in any way affiliated with or by SLC or any of it's affiliates,
and that it is a separate network of computers independent of SLC.
Access to the Internet is dependent on numerous factors, technologies, and
systems, many of which are beyond SLC's authority and control.
The Internet speed of the Customer connection may be subject to
delays caused by the Internet itself and in no way is SLC
responsible for the day-to-day performance of the Internet. The Customer's
use of the Internet is solely at the Customer's own risk and is
subject to all applicable local, state, national, and international laws and
regulations. 15. SLC's network can only be used for lawful purposes. The transmission of any material in violation of any local, state, national, or international law or regulation is prohibited. This includes, but is not limited to, copyrighted material, material legally judged to be illegal, threatening or obscene, material protected by trade secret, or material that is otherwise deemed to be proprietary or judged by SLC to be inappropriate or improper such as bulk e-mail messages. 16. Access to other networks connected to SLC's network must comply with the rules appropriate for that other network. SLC exercises no control whatsoever over the content of the information passing through it's network. 17. The service provided under this Agreement is for the sole use of the Customer, their employees, and their associates at the place of business or place of residence indicated on this Agreement and is not available for resale, reassignment, transfer or use by any other party other than the one for which it is assigned to under the terms of this Agreement. 18. SLC makes no warrantee, expressed or implied, including, but not limited to, those of merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, mis-deliveries or service interruption however caused. Use of any information obtained by SLC's network is at the Customer's own risk. SLC specifically disclaims any responsibility for the accuracy or quality of information obtained through this Internet connection or SLC's network. 19. Routine maintenance and periodic system repairs, upgrades and reconfigurations, public emergency or necessity, force majeure, restrictions imposed by law, acts of God, labor disputes and other situations, including mechanical, electrical or electronic breakdowns may result in temporary impairment or interruption of service. As a result, SLC does not guarantee continuous or uninterrupted service and reserves the right from time to time to temporarily reduce or suspend service without notice. The Customer shall indemnify and hold SLC and it's directors, officers, employees, and agents harmless from any and all obligations, charges, claims, disputes, liabilities, costs and fees incurred as the result of interruptions or omissions of service. 20. SLC reserves the right to monitor the Customer's Internet Traffic that SLC carries to and from the Internet under the terms of this Agreement and SLC’s Acceptable Use Policy. Upon the occurrence of an unresolved default or violation by the Customer of the terms of this Agreement or SLC’s Acceptable Use Policy, SLC reserves the right, in addition to any other legal remedies which may be available, to terminate service to the Customer, upon which the Customer shall pay, immediately, a lump sum equal to the charges for the remainder of the then current term of the Agreement in no case greater than 1 year. 21. The Customer shall indemnify SLC, it's affiliates, officers, directors, licensees, and licensers of any and all claims and expenses, including, without limitation, reasonable attorney's fees arising from the Customer’s breach of any provision of this Agreement. 22. This Agreement is deemed to be entered into within the State of Washington. The parties agree that any dispute arising under this Agreement shall have it's venue in King County, Washington, and any such dispute shall be governed by and constructed in accordance with the laws of the State of Washington. 23. SLC may assign this Agreement without the Customer's prior consent and all of SLC's rights, title, and interest herein shall inure to the benefit of such assignee, it's successors and assigns. This Agreement shall not be assignable by the Customer except with the written consent of SLC. Subject to the foregoing, this Agreement shall be binding upon and inure to the benefit of the parties hereto and their respective successors and assigns. 24. Neither party shall disclose any of the terms and conditions of this Agreement without prior written consent of the other, provided, however, in any of it's sales and marketing materials, SLC may refer to the Customer as it's customer with permission granted by the Customer. 25. This Agreement may be modified only by a written instrument signed by the party against which the modification is being enforced. 26. Any notice required to be given hereunder shall be in writing and shall be deemed to have been delivered when deposited in the United States mail, registered or certified mail, return receipt requested with adequate postage affixed and addressed to the persons set forth in the signature block hereto or to such other address as either party may provide to the other in accordance with the provisions hereof. A copy of any notice to SLC shall be sent to: Seattle Line Communications, Inc. This Agreement contains the entire agreement of the parties hereto with respect to the matters covered hereby and supersedes any other prior or simultaneous agreement relating to such matters.
